DMCA Takedown Policy
Effective Date: January 1, 2025
Every Bit Texas takes intellectual property seriously. The bulk of our historical content comes from public domain archives — the Library of Congress, Wikimedia Commons, and the Internet Archive — along with photos and videos submitted directly by Texas businesses and community members. We do our best to verify that everything we publish is either properly licensed or free for public use.
That said, mistakes happen. If we've ever published something that belongs to you without authorization, we want to fix it as quickly as possible.
How to Submit a Takedown Notice
To file a formal DMCA takedown request under the Digital Millennium Copyright Act (17 U.S.C. § 512), send an email to DMCA@everybittexas.com with the following included:
- Your full legal name and contact information, including an email address, phone number, or mailing address where we can reach you
- A description of the copyrighted work you believe has been infringed, along with a reference to where the original work was first published or where it currently appears
- The specific URL or URLs on everybittexas.com where the allegedly infringing content can be found
- A statement that you have a good-faith belief that the use of the material has not been authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf
- Your physical or electronic signature
Incomplete notices may not be actionable. If you're unsure whether your notice meets these requirements, consult with a qualified attorney before submitting.
What Happens After You File
Once we receive a complete and valid takedown notice, we will:
- Review the claim and the content in question to determine whether the notice is valid under applicable law
- Remove or disable access to the content if the claim is found to be valid and the material is within our control
- Notify the person who originally submitted the content (where applicable) that it has been taken down and the reason why
- Confirm the action taken with you, typically within 10 business days of receiving a valid notice
Counter-Notices
If content you submitted to Every Bit Texas has been removed following a DMCA takedown notice and you believe the removal was made in error — for example, because the material is in the public domain, was properly licensed, or qualifies as fair use — you may submit a counter-notice to DMCA@everybittexas.com .
A valid counter-notice must include your name and contact information, a description of the content that was removed and the URL where it previously appeared, a statement under penalty of perjury that you have a good-faith belief the content was removed as a result of a mistake or misidentification, and your consent to the jurisdiction of the applicable federal court. Once we receive a valid counter-notice, we will forward it to the original claimant and may restore the content following the statutory waiting period, provided no court action is filed.
Repeat Infringers
Every Bit Texas reserves the right to refuse, remove, or permanently block content from any individual or contributor found to be a repeat copyright infringer. This applies to all submitted content regardless of source.
A Note on How We Source Content
Our historical media comes almost entirely from public domain archives or from business owners and community members who have shared their own original content with us. We do not knowingly publish copyrighted work without authorization. If something slipped through despite those efforts, that is a mistake we want to correct promptly and without hassle.
We appreciate you reaching out rather than assuming bad intent. We're a small operation that cares about doing this right.
